A meeting was held at the premises of the Federal Ministry of Justice between Minister Vedran Škobić and the Director of the Federal Administration for Geodetic and Real Property Affairs, Željko Obradović, along with their associates. The topic of the meeting was the current status of the Draft Law on Construction Land.
This Law aims to regulate the area of construction land in accordance with the "new" system of property rights, based on the principles and rules set out in the Law on Real Rights.
Currently, the applicable Law on Construction Land in the Federation of BiH was enacted in 2003 by the High Representative for Bosnia and Herzegovina and then was adopted in identical form by the Parliament of the Federation of BiH.
In 2014, the Law on Real Rights came into force, marking a return of the field of property rights to the Central European legal tradition. This Law introduced key principles such as the unity of ownership, equality of all property right holders, and the principle of unity of property. It also prescribed a general transformation of former social ownership and its legal derivatives (such as the right to manage, dispose, or use property).
The adoption of the new Law on Construction Land is of vital importance for local self-government units. Accordingly, a working group has been established, consisting of representatives from the Association of Municipalities and Cities of FBiH and several municipalities.
Recognizing the importance of this legislative process, it was concluded that a request should be submitted to the Office of the High Representative for BiH to organize a joint meeting with representatives of the Federal Ministry of Justice, the Federal Administration for Geodetic and Real Property Affairs, the Association of Municipalities and Cities of FBiH, and the Office of the High Representative, with the goal of ensuring a coordinated approach to the regulation and adoption of the Law on Construction Land.
